I think it's funny that it is a case of "they're so bad" yet the tv & movie cartels have screwed Aussies to the point they started looking for alternatives. Even our netflix is raped. View it as they will but I dont know a single person under 40 that doesnt download if they are into watching stuff, personally I couldnt be bothered as there is better things to do with life, it's all same stuff repeated... formula movies & shows & music.

& where does it leave people like me who provide internet to house, I dont monitor what wives & gf's & teenage kids do, unlike every other greedy capitalist f***** in this world I respect their privacy. Guess i'll have some extortion letters coming at some point then. But then since the bill payer is the responsible person go download some stuff at the expense of Ronald McDonald, coffee shop or big corporation you visit or work for & really f*** the system up.

Who hasn't?

Just a beat up to scare people, especially those on iiNet. It will work of course, torrent usage will go down and so will the peers. But are they really going to randomly pick someone out of the hat and make an example of them? Yep! But what's the bet it will end up in court here and thrown out.

Maybe some seabreeze IT guru's might be able to help me, but will a VPN solve my D/L issues or do we have to move to TOR or something? I currently use kickass and eztv but are there better options?

I just want to D/L TV shows without govco monitoring me.

Yep I'm pretty much 100% sure no-one has been done for downloading/uploading in this country so far.

As you say gwako that dude was selling like 1000 burned dvds with copied covers etc as a full time business. Totally different kettle of fish to joe bloggs downloading a movie to watch on saturday night.

In the US they have sporadically done 'speculative invoicing' where they send a few thousand letters saying pay $5000 or face fines of $200,000. They basically just sit back and reap the easy money and let anyone that fights it off - not worth their time/money to pursue, they just want to harvest the low hanging fruit and move along - ie those dumb/scared enough to see the big lawyer's names and hand over the cash no questions.

Speculative invoicing will never fly here because we only allow recovery of actual damages - so I'd argue that's $30 for a DVD absolute max - otherwise I'd start at however much a cheap tuesdays movie ticket costs these days. I believe from hearing the yank interviewed this morn that they'll try to pin wider damages on uploaders tho, like you cost us x amount of ticket sales. I can't see it flying that well tho because it's pretty random and it's not a zero sum game - I download the occasional movie but have taken my wife to the cinema exactly once in 10 years and that was when she won 2 free tickets and threatened to divorce me if the year long expiry date ran out and I had a week left. Point is they need to prove that they're losing out actual money not just theoretical possible ticket sales. There is a well documented argument that 'piracy' leads to sales rather than diminishes them - if you like a movie or cd enough convince mates to see it on the big screen/buy the original to get artwork etc/ see the band live when if you didn't get a copy to begin with you'd not know about it..

Second, judge said all letters have to go thru him. So that's interesting, could be a rubber stamp or could be a total block (too busy this month, next month, etc).

Third, company said they don't want bad publicity, and won't sue kids, the disabled, war veterans or service personnel, pensioners, or anyone else the public is sympathetic to. So it's wouldn't be hard to dredge up someone in those categories to take the blame.

Fourth, you can use 'I didn't do it" as a defense, onus is on them then. Untested, but more than likely to be effective in many situations.

All in all, if you're going to d/l movies now I'd turn seeding off - not nice but they've indicated only "uploaders" are of interest, whether that means torrent file creators, or anyone who runs over and seeds for a while.

What you'll want to do is covert your movie (avi/mp4) to a MKV file than add them to that. Very easy to do.
Step 1
Download and install this
http://m.en.softonic.com/app/mkvtoolnix

Step 2
Get your desired subs (full subtitle or foreign language parts only) from here
subscene.com/

Step 3
Drag and drop movie to MKVtool.
Drag and drop subs to MVKtool.
click on the subs in the main box than tick off the box on the left side.
Now go the the bottom box set language as English.
Turn default track to on.
Turn forced track to on.
Press start [start muxing]

Enjoy

Downloading is not illegal. There is no mention of it in the crimes act. A policeman can't arrest or charge you for it. It is a civil matter and an arguable one at that.

There are a lot of articles at the moment using incorrect terms like 'illegal' and jumping to all sorts of conclusions.

As for immoral, fair enough, as seen in the scams thread recently everyone has a position.

Is it that arguable? You are using/copying something without paying for it. The copyright holder hasn't given you the right to use it.

If you extend this same logic to other things, it becomes a free for all. Just because it doesn't appear to be a theft doesn't mean you aren't depriving someone from their legitimate income.

I guess technology makes it hard to keep people honest when its so easy to copy music and movies.

You could argue that refugees coming into Australia are not 'illegals' either, as every human has a right to live and this is stamped and signed by every country in the UN. In fact I am sure we've also signed an agreement with other countries to share information, data and that includes movies and songs of entertainment value.

Well legally yes, there are many legitimate avenues of argument, nothing is clear cut.

As far as depriving someone of legitimate income, well that's most definitely arguable as well. Since the days of taping songs off the radio the copyright bodies have been crying that any unauthorised copy / play is depriving them of income. The stats have generally proven the opposite - far from killing music home taping grew music as a commodity. This 1982 campaign was all for naught.

I know a lot of people who wouldn't pay to go see a movie at the cinema unless soneone they knew had strongly recommended it - and that mostly happens by downloading. A good product will make legitimate money. Dallas Buyers Club was not a good product. It was, ironically, about a man who couldn't get product in a timely & cost effective manner so he broke the rules to get it.

I think that downloading is a good thing for climate change. To go to the cinimas requires the person to dirve there. When the data is taken from Itunes and such, there is a payment transaction that uses more electricity than if it were just downloaded.

Sure. Give away your time for free, and then tell me about 'anarchy'.

I don't know what your 'stats' really say, but I doubt they are saying that copying leads to more sales. Maybe in the days of cassette tapes versus CDs, but not now. I can't notice the quality difference, so why would I buy it?

I know people that will happily share copied DVDs. If a person watches that at home, they won't go hire it from a video store, even if they really liked the movie.

So, it is depriving the artists or producers of money.

Your argument about cassette taping is not so good in that the quality back then was pretty poor. MP3 now leaves that for dead, and most people won't care about the slight improvement to CD. If they do, they would probably download a better version, or even buy it.

Why are you even worrying about the 'legality' line of reasoning? Just because something may not be deemed illegal does not make it right.

If you produced something that involved a lot of your talent, creativity, and money, would you happily share it with everyone else for nothing?

In my experience, people that go to movies, go to a lot of movies. They don't worry about what someone else said about it. I don't go to see many movies at all, but I know of people that go all the time. Good movie or bad, they go and see it. If they recommended a great movie to me, I still wouldn't see it unless I just happened to be wanting to see something.

Similarly, someone that downloaded it and said it was great is not going to affect whether I see it, and probably not for regular movie goers either.

Actually, in my case I do actually remember going to see a movie based on a work colleagues recommendation. It was rubbish. I guess there's no certainty that you have the same sense of humour as another. I guess if I had downloaded it, I would have watched the first 10 minutes of it and then deleted, and that would have saved me wasting my money at the cinemas.

Maybe piracy only affects "crap" movies? Nah...

Sotired I'm giving you greens because I like a good argument etc, it's not me with the reds.

I'm not quite invested enough to go full in depth reply, I did see this just now which was interesting considering the first 4 eps of GOT 'leaked' yesterday and half of Oz has seen them already.

Game of Thrones director David Petrarca previously admitted that piracy generated much-needed "cultural buzz"around his show. Similarly, Jeff Bewkes, CEO of HBO's parent company Time Warner, noted that piracy resulted in more subscriptions for his company and that receiving the title of "most-pirated" was "better than an Emmy."

Petrarca responded by saying that all these unauthorized downloads don’t matter because shows such as Game of Thrones thrive on “cultural buzz” and benefit from the social commentary they generate.“That’s how they survive,” he said during a panel discussion at the University of Western Australia.

No worries, I figured it probably wasn't you red-thumbing. People seldom compose an argument and also red-thumb. It sort of defeats the purpose of going to the point of demonstrating your point of view and also red-thumbing.

Red thumbs are not a bad thing anyway. I don't mind that other people disagree. It would be a boring world...

No amount of piracy with Game of Thrones is going to make me watch it. Its a TV series isn't it? So, TV broadcasters are going to buy it to get an audience so they can show ads, or sell subscriptions. I can see how the argument works that people would hear about it and watch the program. I would contend though that the same people that watch the downloaded version would not bother to watch it on a commercial channel with ads, or pay for a subscription to watch it on pay-tv.

Back a few years ago, a copied program was where someone filmed it in a cinema and sold the bootleg copies. The quality was poor. Now, you can download the actual program, and even add subtitles if you want to, and have excellent quality. Not even a single cough from the audience or someone standing up in the middle of the movie

Now, if you gave me a copied version of a movie, and I watched it, I would never bother paying to watch it again, as I generally only watch a movie once. Otherwise I am quite happy to pay to rent a DVD or go to a cinemas, but if I have already seen it, what would be the point?

With everything that is going on now I have just taken out a Netflix account and have revived my iTunes account. At $12 a month for Netflix with thousands of titles in HD, on demand and with no ads... how could you not. Previously I could not justify the cost of Foxtel subscriptions - then have to watch it on their timetable AND cop the ads...

Does Netflix actually show current series (ie GOT, NCIS LA, Revenge etc) or just release the content like they did / do with OITNB etc.

If it doesn't show current series, why would you bother? Hyping up shows like Entourage and SOA is a bit pointless when the are long gone.

Some new/current stuff - Orange is the new Black / House of Cards / The Black List / Top Gear etc etc... not sure how many seasons behind it is, but there is enough there to find something good to watch. Few decent movies that I have missed also... so whilst there's definitely some shows missing, I am happy enough for $12 a month. Plus you can cancel at any time...

It asks you to rate Movies and TV shows to build a profile of your likes and dislikes and then puts forward suggestions.

What I have found NOT to be on Netflix:

The Walking Dead
The Following
Revenge
The Big Bang Theory
Modern Family
American Pickers
American Restoration
Auction Hunters

Netflix is awesome, I've subscribed, and it's unmetered with iinet. The only real issue for me is no GOT.

The walking dead - 3 episodes per season utterly amazing, rest just filler of boring moralistic religious interpersonal dramas...
Revenge - terrible soapy, wife likes
Not heard of The Following but the rest I can happily live without

I think a lot of the missing shows could be solved if they bring "HBO Now" here. For another $15 a month you could have all the rest that matters.

I just found out my father in law pays $130 a month to Mr Murdoch for foxtel - and his picture quality is awful. It's the rugby that has him hooked. No wonder murdoch killed the NBN.

The last survey included questions about household VPN and web proxy use. The results were rather surprising. Twenty per cent of respondents indicated they use either a VPN or a web proxy, or both, to access the internet and download files at home.As these figures suggest, there is clearly a high degree of familiarity with privacy software among the Australian population. One in five people know how to use these tools.

thedrip,

Best post I could see in this thread, if the entire population lived by this, the new laws would have never been necessary. Which resrict both the law abiding citizen as well as the thieves.

Always the same. The law abiding citizen pays for the lack of restraint of the disobedient, in the restriction of freedom and services.

And I live by the same principle. If I want to watch something, quite prepared to pay for it, whether by buying DVD's, or paying for Wifi.
